1. INTRODUCTION

These are the terms and conditions of musician (diploma) Ralf Gregor represented by his company  Ralf Gregor Music, Hamburg, Germany in relation to offering his service of omposing custom music to corporate and individual clients.

2. GENERAL

Please carefully read our terms and conditions document which applies to every assigment that Ralf Gregor agrees to take. All conditions apply to the service provider and the client.

Our terms and conditions have been designed to offer protection and peace of mind to all parties and to ensure the safety of the client and the service provider.

3. ORDERS

3.1    When the client has sent a message on the website with a request for custom music and Ralf Gregor has replied with an offer for this service and the client agrees to this offer by sending the fee for this service to Ralf Gregor’s PayPal account,  a purchase agreement has been entered into between the client and Ralf Gregor. Ralf Gregor recommends the client to save the order confirmation for any future contacts with our customer service. The order confirmation is also the receipt that the purchase has been completed.

3.2    The client is responsible for ensuring that the information provided, such as email, name and address is correct and up to date.

4. PRICES AND PAYMENT

4.1    The prices on our website apply to orders placed on the website. All prices are shown including VAT (for delivery within the EU). VAT is not included in countries outside the EU.

Ralf Gregor offers his service of composing custom music worldwide.

4.2    The client is responsible for any customs duties being paid to the customs or equivalent authority in the country to which the product / products are finally delivered.

5. CUSTOM MUSIC SERVICE

5.1    Ralf Gregor offers corporate and individual clients the service of creating and producing professionally custom music, music tracks composed individually for the client, including all rights to this music track.

5.2    The client receives a payment conformation via e-Mail from PayPal right after purchase and a second e-Mail from Ralf Gregor to confirm the appointment including sending the client the link to participate in the video call by Zoom or Skype. Please check your junk mail folder after purchase to get all information required to join the video call on time.

5.3    The client can always contact our customer service via e-Mail to:  custom-music@ralfgregormusic.com in case of any questions concerning the service. The customer service usually replies within 48 hours.

5.4    Both service provider and client will enter the Zoom video meeting in the proposed agreed time online. The client is responsible to be able to participate in a online video call on Zoom that requires internet access and an internet-capable device such as a computer notebook, tablet or smartphone. 

5.5    Using the audio function for the video call is mandatory, while using the video function is voluntary for the client. 

5.6    The video call for each custom music service purchased runs about 20-40 minutes. In case that the client wants to end the session earlier, this is possible but will not reduce in any way the fee paid.

5.7    After completing the video call with the client Ralf Gregor composes  the custom music track for the client within 7-10 days and sends the mp3-file to the client via e-Mail or offers to the client a password-protected download function on his website to download the music file.

5.8    In case the client wishes small changes to the music file in terms, Ralf Gregor agrees to send the client one revised version of this music track within five working days included in the custom music service.

6 CANCELLATION AND WITHDRAWAL

6.1    In case that the client cannot or does not want to join the video call  as booked, a minimum of 24 hours’ notice of cancellation is required via e-Mail to: custom-music@ralfgregormusic.com to declare an alternative date and time within 4 weeks after the initially booked date.

6.2    Once a custom music service is booked by the client, Ralf Gregor does not accept any refunds, but offers up to two alternative dates within 4 weeks after the initially booked date.

6.3    In case that the client does not agree to an alternative date within 4 weeks after the initially booked date, the custom music service expires.

7 LATENESS POLICY

7.1    If the client is late for the video call, the video call will not be extended and will end at the appointed previously agreed time.

7.2    If the service provider is late, additional time will be added to the session, or to a subsequent session.

8. ADDITIONAL INFORMATION

Ralf Gregor reserves the right to refuse a client's order without giving reasons. In this case, Ralf Gregor will refund the rejected customer the fee paid for the purchased mentoring session within 2 business days via PayPal™ transaction.

9. FORCE MAJEURE

Ralf Gregor’s custom music service shall be exempt from damages and other measures if the performance of the agreement is prevented or delayed by any circumstance beyond our control, e.g. extreme weather, new / amended legislation, absent permits, war, fire, flood, labor market disturbances, technical problems, sabotage, unfavorable transport, terrorist attacks, changed governmental orders as well delays in the service by sub-suppliers due to circumstances set forth above. Ralf Gregor shall inform the client/mentee accordingly if any such circumstances should arise, and if the situation has lasted more than six weeks, both the client and Ralf Gregor have the rights to cancel the purchase with immediate effect.

10. CHANGES TO THE TERMS AND CONDITIONS

Ralf Gregor may make changes to the Terms of Conditions for custom music service from time to time. When these changes are made, Ralf Gregor will make a new copy of the Terms and Conditions available on his website.

Your continued use of our website after any changes to the Terms and Conditions means you accept the changes.

11. GOVERNING LAW

These General Terms and Conditions and any separate agreements in which we offer services to you shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.
